Terms and Conditions - Virtual Gallery

The following document « Terms and Conditions » is a translation of the original « Conditions Générales de Vente » available in the French section of this website, which is the only valid document in case of litigation.

The objective of this section is to define the rights and obligations of our company and its consumers in the context of online sales for the items proposed in the section « Buy online» of this website. All purchase orders completed by the client imply his/her acceptance of the present « Terms and Conditions ».

SCS Mondes d’Hier reserves the right of adapting or modifying at any time the present Terms and Conditions. Clients should refer to the version published at the moment of completing his/her order in case of complaint.

1. Purchase process :

Items offered for sale on the section « Buy online» on the website « Guerrin Arts & Auctions » are presented and detailed so that clients are able to know the essential characteristics of the objects that is willing to buy.

All items on the website are photographed in professional conditions and accompanied by a precise description. We always provide information about the state of the object.

Some objects don’t show any price in their description. In that case clients are invited to contact directly Mondes d’Hier via email or telephone to receive this information in private.

Users will be able to select one or several objects in the gallery and add them to « My selection ». Click the button « My selection » in the header of the website to access a summary of the selected items, their unitary price and the global amount for the order. It will be possible to delete one or several items at this step.

When the selection is ready to be validated, the user can click on the button « command » and he / she will be redirected to a form to register in our system with his personal informations. If this process has already been completed in a previous session, just login user and password will be necessary.

Once the user has logged in, the user will be invited to accept or modify his coordinates or delivery and to choose the method of payment.

The buyer must accept the present Terms and Conditions in order to finally validate the order.

In the term of maximum 24 hours, Mondes d’Hier will send the user a message via e-mail with the order summary confirming the treatment and resuming all the informations concerning the order, the items, the paiement, the delivery, as well as the ways of exercising his right of withdrawal.

Delivery is effectuated in 3 opening days counting since the date of reception of the order payment, except other specific demand from the part of the client. The buyer will receive an email to confirm shipping with the code to follow the parcel.

The delay of delivery is variable depending on destination and the shipping company. 

Exceptionally, during vacation period, we might be unable to deliver the item in a 3 day delay. In that case, we will contact you to figure out a possible delivery date. At that moment, you will also have the possibility to annulate your purchase and be reimbursed immediately

2. Prices :

Prices are expressed in euros and include taxes.

Shipping costs will be added to the price during the purchase process.

For any delivery outside of Belgium, customs fees or any local taxes will be paid by the buyer.

SCS Mondes d’Hier reserves the right of reviewing its prices at any time but guarantees the client that the prices published at the moment of commanding will be the ones applied.

3. Shipping:

Shipping cost are offered by Mondes d’Hier SCS. Delivery is executed by Bpost.

Nevertheless, the buyer can request a special delivery with another carrier at his own expense.

4. Payment:

Every objet should be completely paid before delivery. The payment methods is chosen by the client between the options proposed by Mondes d’Hier SCS:

• Credit Card

Payments are secured and made through Paypal. The credit card details are encrypted by SSL (Secure Socket Layer) and never transmitted unencrypted over the network.

SCS Mondes d’Hier has no access to details disclosed. As a result these details are not stored on servers and are demanded again for each transaction on the site.

Please mention in the transfer details the number of purchase that figures in the e-mail that you receive after the order procedure is completed.

The buyer has a period of 10 days to complete the payment, after this period its purchase will be canceled. It will be possible to pass a new order online after if the item is still available.

• At our physical gallery

Our physical gallery is situated at Rue Blaes 166, 1000 Bruxelles. We dispose of a card payment system compatible with Bancontact, Visa and Mastercard. Cash payment is also possible for purchases whose total value is below 3000 euros.

Before coming to the gallery, we advice to contact us by telephone (0032 476479564) or to fix a rendez-vous via the form on our website to confirm the opening hours the day you want to make our visit. 

 • Bank check

It is possible to pay by bank check addressed to « Mondes d’Hier SCS ». To do so, select this option during the process of purchase (payment button). The client will be contacted by our services within the following 24 hours to give further details and instructions depending on the country of origin. 

5. Shipping :

The items that are published on this website are immediately available. The expedition is made within 3 calendar days since the date of payment reception. The buyer will receive and email to confirm the expedition of the order with a number/code to follow the parcel.

The delivery period is variable and depends on the time that is necessary for the carrier. In general, deliveries inside Belgium take 24 to 48 hours since the date of shipment. For Europe, the delay is approximately one week. In any case, SCS Mondes d’Hier cannot be held responsable for delays due to the carrier.

The eventual custom fees or supplementary taxes are in charge of the client.

Important note: Several countries outside EU forbid the importation of articles containing parts coming from species in danger of extinction. Some objects in the gallery could be included in that category, be sure to be familiar with this rulings for your country.

To reduce its environmental footprint, Mondes d’Hier tries to pack its parcels in recycled, recovered packaging.  All our objects are checked before packaging and shipping. 

6. Damaged objects

Please declare any object that is damaged during transportation in the 48hours that follow the reception of the parcel (post tracking date taken into account). A complete and detailed description of damages, as well as pictures, should be provided by email. After this delay, Mondes d’Hier reserves the right to consider the claim or not. 

7. Right of withdrawal

Belgian law about commercial practices and consumers information and protection of the 6th April 2010 authorizes the consumer to refuse his purchase in the 14 calendar days that follow the delivery date or the contract ending. In the case that a client wants to execute its right of withdrawal: 

• The article soudé be sent back in the 14 days after expressing the will of withdrawal. 
• The buyer is responsable of the total cost of shipping back the article, including shipping costs, insurance and packaging. No refund will be applied for this costs.
• Returned articles should be insured by the client agains lost or damage for their total value.
• Returned articles should be in the same state that when they were delivered.
• Articles that have been damaged, modified or falsified cannot be returned.
• Refund will be executed after reception and inspection of the returned articles.

8. Ownership reservation :

In accordance with law n°80.335 of 12 May 1980, SCS Mondes d’Hier reserves ownership of delivered goods until full payment of their prices.

9. Newsletter

By clicking the case for this purpose or giving directly his acceptance, the user accepts that SCS Mondes d’Hier sends, in the means and frequency that it determines, a newsletter containing information related to its activities.

Inscribed users will be able to unscribe at any moment by clicking the link foreseen for that purpose included in every newsletter. 

10.Dispositions and freedoms:

Informations requested to the client are necessary to the execution of the purchase orders.

Data files remain internal to SCS Mondes d’Hier and every user has a right to access and rectify information concerning himself in accordance with the Data Protection Act of 6 January 1978.

11. Disputes :

These general conditions of sale are governed by Belgian law.

Any dispute concerning the interpretation or execution of orders will be reviewed with the utmost care and will be the subject of an amicable proposition immediately. In case of unresolved dispute between SCS Mondes d’Hier and the buyer, only the nearest commercial court to SCS Mondes d’Hier will be competent in the matter.
